Terms and customer information

Scope and contract

These terms apply to deliveries and services by Franz Huisgen GmbH & Co. KG to consumers and business customers. Product descriptions in online shops are not binding offers; the customer submits an offer by order, enquiry, phone, email, fax, post or contact form. Acceptance may be made by order confirmation, delivery or payment request.

Prices, payment and delivery

Unless stated otherwise, prices include statutory VAT. Additional delivery, shipping, import, bank or currency costs may apply depending on destination and payment route. Deliveries are made to the delivery address stated by the customer; freight deliveries are made to kerbside unless otherwise agreed.

Retention of title and warranty

Goods remain the property of the seller until full payment has been received. Statutory liability for defects applies. Customers are asked to report obvious transport damage promptly so claims can be clarified quickly.

Custom processing

If goods are processed according to customer specifications, the customer must provide all necessary files, drawings, texts, images, data and usage rights. The customer is responsible for ensuring that no third-party rights are infringed.

Law, jurisdiction and dispute resolution

German law applies, subject to mandatory consumer protection rules. Where legally permissible, the place of jurisdiction is the registered office of Franz Huisgen GmbH & Co. KG. The European Commission provides an online dispute resolution platform at https://ec.europa.eu/consumers/odr. The seller is not obliged or willing to participate in dispute resolution before a consumer arbitration board.
